These Terms of Service ("Terms") are a legally binding agreement between you ("you" or "Customer") and Viggenz ("Viggenz", "we", "us", or "our"), governing your access to and use of the Viggenz website (https://viggenz.com) and any purchases of digital products (software license keys) made through our site. By accessing our website or purchasing our products, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.

Please also review our Privacy Policy, which describes how we collect and use your personal information. The Privacy Policy is incorporated into these Terms by reference.

1. Eligibility and User Account

Eligibility: Our services are intended for users in the United States. By using this site and making a purchase, you represent that you are located in the U.S. and have the legal capacity to enter into this agreement. We do not impose a strict age restriction for purchasing; however, if you are under the age of 18, we ask that you use our site only with the involvement and consent of a parent or guardian. Our site is not directed to children under 13, and you may not use our services if you are under 13 years old.

Account Registration: You may have the option to create a customer account on our website for easier checkout and access to your order history. If you choose to register, you agree to provide accurate, current, and complete information during registration and to update this information promptly if it changes. You are responsible for maintaining the confidentiality of your account login credentials and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account. If you suspect any unauthorized use of your account, you must notify us immediately. We reserve the right to suspend or terminate accounts that violate these Terms or that are used for fraudulent or illegal activities.

2. Products and Services

Viggenz sells digital software licenses and product keys for various software programs. When you purchase a product from us, you are buying a license key that allows you to activate and use the corresponding software, subject to the software publisher’s End User License Agreement (EULA) or terms of use. We are not the developer or publisher of the software for which we sell license keys. The software itself is provided by the third-party manufacturer or copyright owner (for example, Microsoft if you purchase a Windows key). By purchasing a key, you agree to comply with any applicable EULA or usage terms of that software.

License and Usage: Upon successful purchase, you are granted a license (through the product key) to use the software in accordance with the software publisher’s license terms. This license is usually for personal use on a specified number of devices (often one) unless otherwise stated in the product description. You do not obtain ownership of the software itself; ownership remains with the software publisher. You must not use the key to activate more installations or devices than allowed, nor engage in any unlawful copying or distribution of the software.

No Affiliation: Viggenz is an independent reseller of software licenses and is not affiliated with, endorsed by, or an authorized agent of the software publishers unless explicitly stated for a particular product. Product names, logos, and trademarks that appear on our site are the property of their respective owners and are used only to identify the products for sale.

3. Pricing and Payment

Pricing: All prices on our website are listed in United States Dollars (USD). We strive to ensure that our pricing is accurate and up-to-date. However, in the event of a pricing error (e.g., a product listed at an incorrect price due to a typo or technical issue), we reserve the right to cancel or correct the order. If you have already been charged and your order is canceled due to a pricing error, we will issue a full refund of the amount paid. Prices are subject to change at any time before you place an order. Any applicable taxes or fees (if any) will be shown at checkout. Currently, as a UK-based business selling to U.S. customers, we do not charge U.S. sales tax, but you are responsible for complying with any local tax laws in your jurisdiction.

Payment: Payment is due at the time of order. We accept payment via PayPal and Stripe (major credit and debit cards). By providing a payment method, you represent that you are authorized to use that payment method and you authorize us (or our third-party payment processors) to charge the full order amount to that payment method. All billing information you provide must be current, complete, and accurate. Viggenz does not store your full credit card details on our servers; all transactions are processed securely by our payment partners. In case your payment cannot be processed (e.g., card decline or PayPal issue), the order will not be completed, and we will prompt you to use an alternate payment method.

Order Confirmation: After you place an order and payment is successfully processed, you will receive an order confirmation via email. This email will summarize your order details and serve as your receipt. If you do not receive a confirmation email within a reasonable time after purchase, please check your spam/junk folder or contact our support.

4. Order Fulfillment and Digital Delivery

Digital Delivery: We deliver all products electronically. Once your payment is confirmed, your software license key and any necessary instructions will be delivered via the email address you provided at checkout. Delivery is typically instant or within a few minutes of purchase. In rare cases, delivery may be delayed up to 24 hours (for example, if an order is flagged for manual review or if we experience technical issues). There are no shipping charges for digital delivery.

Email Address Accuracy: It is your responsibility to provide a valid and accessible email address. We are not responsible for non-delivery due to an incorrect email or issues with your email service (such as spam filters or full mailbox). If you haven't received your product key within a few minutes, please check your spam or promotions folder. If it's still not there after a short while, contact our support and we will assist you in obtaining your product key.

Order Issues: If you encounter any issue with the delivered product key (for example, the key appears invalid or you did not receive the email), you must notify us as soon as possible so we can assist. We guarantee that you will receive a functional product key as advertised, or we will provide a remedy in line with our Refund & Return Policy (such as issuing a replacement key or a refund, depending on the situation).

Right to Refuse or Cancel: We reserve the right to refuse, cancel, or limit any order at our discretion. For instance, we may cancel an order if it appears fraudulent, if we have reason to believe the purchaser is not in our target market (outside the U.S.), or in cases of obvious errors on our website. We may also limit the quantity of a given product that can be purchased by a single customer (for example, to prevent bulk resale or abuse). If we refuse or cancel an order, we will make reasonable efforts to contact you through the email or billing information provided, and any payment collected will be refunded promptly.

Fraud Prevention: To protect against fraud, we may use various verification procedures. We reserve the right to require additional information or verification from you before accepting an order (such as verification of billing information or identity) if our systems detect a potential risk. If you fail to provide requested verification, we may cancel the order for security reasons.

5. Returns and Refunds

Because our products are digital and delivered instantly, we cannot accept returns in the traditional sense. However, we want you to be satisfied with your purchase. Refunds may be granted under certain limited conditions, as detailed in our separate Refund & Return Policy page. Generally, eligible cases for refund include (but are not limited to) situations such as:

  • The digital key or software license you received was defective or invalid (e.g., the key could not be activated through no fault of your own).

     

  • You accidentally purchased the same product twice.

     

  • The product delivered was not as described or was the wrong product.

     

Change of mind or buyer’s remorse alone is not a valid reason for a refund, given the nature of digital goods, except where required by law. For example, if consumer protection laws in your jurisdiction provide a cooling-off period or other rights for digital purchases, we will honor our legal obligations.

To request a refund, follow the procedures outlined in the Refund & Return Policy (typically, contacting our customer support at support@viggenz.com with your order details and reason for the request, within a specified time frame). We will review your case and, if it meets our refund criteria, issue a refund to your original payment method. Approved refunds are usually processed within a few business days, though it may take additional time for your bank or credit card company to post the credit.

6. Usage Rules and Prohibited Conduct

By using our website and services, you agree to the following:

  • Lawful Use: You will use the Viggenz website and products only for lawful purposes and in accordance with these Terms. You will not use the site to engage in any illegal activities or fraudulent purchases.

     

  • Prohibited Activities: You will not engage in activities that could harm us or other users, including but not limited to:

     

    • Attempting to gain unauthorized access to the site or another user's account, or any non-public portions of the site.

       

    • Introducing any harmful code, viruses, or malware, or otherwise interfering with the proper functioning of the website.

       

    • Circumventing or attempting to circumvent any security measures or payment procedures on the site.

       

    • Using bots, scrapers, or other automated means to access or scrape data from the site without our permission.

       

    • Misrepresenting your identity or affiliation when communicating with us or other users (e.g., impersonating the company or staff).

       

  • No Resale or Exploitation: You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of our products or website content without express written permission from Viggenz. The digital keys you purchase are for your personal or internal business use only (depending on the license terms of the software) and not for resale or unauthorized distribution.

     

We reserve the right to terminate or restrict your access to our service if you violate any of the above rules or engage in any behavior that we deem harmful, abusive, or unethical.

7. Intellectual Property Rights

Site Content: All content on the Viggenz website, including text, graphics, logos, images, software (other than the software license keys we sell), and design elements, is the property of Viggenz or our content suppliers and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited license to access and make personal use of our site for the purpose of shopping or learning about our services. You may not reproduce, distribute, modify, or create derivative works from our website content without our express written consent.

Trademarks: "Viggenz" and our logo are trademarks or service marks owned by us. All other product names and company logos mentioned on our site are trademarks of their respective owners. Use of these names or logos on our site is solely to identify the products being sold. Your use of our site does not grant you any license or right to use any trademarks displayed on the site without the owner's prior written permission.

User Content and Feedback: If our website allows you to post reviews, comments, or other content ("User Content"), or if you provide feedback or suggestions to us, you grant Viggenz a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, adapt, publish, translate, and display such content in any media. This license is solely for the purpose of displaying and promoting your review on our platform or incorporating feedback to improve our services. You retain ownership of your content, and you represent that any User Content you provide is truthful and that you have the rights to post it. You shall not post any content that is unlawful, defamatory, infringing, or otherwise objectionable. We reserve the right (but not the obligation) to remove or edit User Content at our discretion.

8. Disclaimer of Warranties

"As-Is" Basis: Viggenz provides the website, its services, and all digital products on an "as is" and "as available" basis. While we strive to ensure that our product keys are valid and our service is reliable, we make no representations or warranties of any kind, express or implied, about the website's operation or the information, content, or products available through it, except as expressly stated. You agree that your use of our site and services is at your sole risk.

Warranty Disclaimer: To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, regarding our site and the products sold through it, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that:

  • Our website will be available at all times, or that it will be error-free and secure.

     

  • The software obtained via our product keys will meet your expectations or requirements (for example, we cannot guarantee the software is fit for your specific hardware or use case; that is determined by the software publisher).

     

  • Any defects on our website will be corrected immediately.

     

Third-Party Software: Any software for which we supply a license key is provided by a third-party manufacturer, not by Viggenz. We are not responsible for any issues arising from the software itself (such as software bugs, compatibility issues, or any harm the software might cause to your system). Any warranties or guarantees for the software product (if any) are those provided by the software publisher under their EULA. For instance, if the publisher offers customer support or updates, those are subject to the publisher's policies.

Limitation: Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, any warranties that cannot be disclaimed are limited in duration to 30 days from the date of purchase (or the minimum period allowed by law).

9. Limitation of Liability

To the maximum extent permitted by law, under no circumstances shall Viggenz, its owners, directors, officers, employees, affiliates, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the site or the products purchased, even if we have been advised of the possibility of such damages. This includes, without limitation, damages for loss of profits or revenue, loss of data, loss of goodwill, computer damage, or other intangible losses.

In no event shall the total cumulative liability of Viggenz and our affiliates to you for any claims arising out of or relating to these Terms or the use of our products exceed the amount you paid to us for the specific product or order in question. For example, if you purchased a software key from us and have a claim related to that purchase, our maximum liability would be the price you paid for that key.

Nothing in these Terms shall limit or exclude our liability for any liability that cannot be limited or excluded by law, such as liability for death or personal injury caused by our gross negligence or intentional misconduct. Additionally, the limitations above are not intended to deprive you of any protections provided to you under consumer protection laws in your jurisdiction; they apply only to the extent allowed by applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Viggenz and its parent company, affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) that arise from or relate to:

  • Your use or misuse of our website or products.

     

  • Your violation of these Terms or any policy referenced herein.

     

  • Your violation of any law or regulation, or the rights of any third party, in connection with your use of the site or products.

     

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (at our expense), in which event you agree to cooperate with us in defending such claim. You agree not to settle any such matter without the prior written consent of Viggenz.

11. Governing Law and Jurisdiction

These Terms of Service and any disputes arising out of or related to your use of the site or purchase of products shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of laws principles. Viggenz is a company registered in the United Kingdom, and we have chosen the laws of England and Wales to govern our agreement.

If you are a customer located in the United States, please note that you are engaging with a UK business. We value our U.S. customers, and nothing in these Terms is intended to deprive you of the protections of U.S. consumer laws that may apply. However, by agreeing to these Terms, you acknowledge that the laws of England and Wales will control in the interpretation and enforcement of this agreement.

Jurisdiction: You agree that any legal action or proceeding arising out of or related to these Terms or your use of the services shall be brought exclusively in the courts of competent jurisdiction in London, United Kingdom, unless otherwise required by applicable consumer law (for example, laws that might allow you to pursue a claim in your local courts). You consent to the personal jurisdiction of these courts and waive any objection to inconvenient forum.

12. Changes to These Terms

Viggenz reserves the right to update or modify these Terms of Service at any time. If we make changes, we will post the updated Terms on this page with a new "Last updated" date. In some cases, we may provide additional notice to you (such as a banner on our website or an email notification, if appropriate). It is your responsibility to review these Terms periodically for any updates.

By continuing to use our website or services after any changes to the Terms are posted, you accept and agree to be bound by the updated Terms. If you do not agree to the revised terms, you should stop using our site and services.

13. Miscellaneous

Entire Agreement: These Terms (along with any other policies or rules referenced herein, such as the Privacy Policy and Refund & Return Policy) constitute the entire agreement between you and Viggenz regarding your use of our service, and supersede any prior or contemporaneous understandings and agreements.

Severability: If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Viggenz.

Assignment: You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to an affiliate or in connection with a merger, acquisition, or sale of assets, or by operation of law.
